Terms and Conditions of Use and Sale

  1. User Agreement
    By using the Nicofree.com.au website (and mobile site) and our social media pages (“Website”) you accept these terms and conditions (“Agreement”) and our Privacy Policy. This Agreement is between you and NicoFree (referred to in this Agreement as “we”, “us” or “our”). We may change these terms at any time by posting changes on the Website. By continuing to use the Website, you agree to be bound by the changes.

  2. Registration and User Requirements
    You must be a registered member to access some features of the Website or our services. When you register, you provide us with personal information including your name, address, and a valid email address. You must ensure this information is accurate and current.
    To register or use the Website you must be at least 18, have a current Australian residential address, and have capacity to enter a legally binding agreement with us.
    By using the Website, you consent to us sending you direct marketing communications to the email address you provide (you may unsubscribe at any time). Some communications may be implied from functional use (e.g. cart reminders).

  3. Access and Use of the Website
    You must only use the Website through the interfaces provided and in accordance with these terms and applicable law.
    You must not (or attempt to):
    – Interfere with or disrupt our site or its networks;
    – Use data mining, robots, screen scraping or similar tools;
    – Interfere with security-related features; or
    – Use, copy or distribute content without our express permission.

We may refer fraudulent or illegal activity to the relevant authorities. You are responsible for all activity on your account and must keep your password secure. Notify us immediately of unauthorised use.

We do not warrant that the Website will always be available and without disruption and we provide no warranties in relation to linked websites.

  4. Information on this Website
Product information is based on material provided by suppliers. Except as required by law (including the Australian Consumer Law), we cannot be held responsible for inaccuracies caused by third parties. Make your own enquiries to verify information before ordering.
Some actual goods may differ slightly in visual appearance from images on the Website.

  5. Disclaimer and Liability
To the fullest extent permitted by law, we exclude all liability for loss or damage of any kind relating to the Website, including (but not limited to):
– Errors or inaccuracies on the Website;
– Acting or not acting on information contained or referred to;
– Personal injury or property damage from use of the Website;
– Unauthorised access to servers or personal information;
– Bugs, viruses, trojan horses or harmful code transmitted by third parties;
– The quality of any product or service of linked sites.

Where the law provides a guarantee which may not be excluded, our liability will be limited to that provided by law. You accept sole responsibility for the legality of your actions under applicable laws.

  6. Indemnity
You indemnify us and our directors, officers, employees and agents from and against any loss or liability incurred arising from any claim, demand, suit, action or proceeding where such loss or liability arose in connection with your conduct or breach of this Agreement.

  7. Placing Orders
Orders placed by you are offers to purchase goods under this Agreement. Goods are not reserved in-cart; an order is finalised when you complete checkout, receive confirmation, and payment is received in full.
We use automated fraud detection software and may delay or cancel flagged orders. We reserve the right to reject and refund orders at our discretion where fraud is suspected, goods cannot be shipped, or a pricing/product error has occurred.
Review your order carefully before placing it. Once confirmed, you cannot cancel or change it except through the normal returns process.
If we cancel or cannot fulfil your order, we will refund your payment.
We may notify you that goods have become unavailable. You may receive a refund or store credit at your election.

  8. Guest Checkout
You may purchase without creating an account. Personal information provided will be collected in accordance with our Privacy Policy.

  9.  Price, Payment and Discount Codes
Prices are in Australian dollars. All payments must be received in full before dispatch. A discount code is only valid for a single transaction and may not be used with other discounts.

  10. Store Credits
Unused store credit remains in your account. Store credits expire after 12 months (or 3 months if issued for goodwill/promotions). Store credits cannot be redeemed for cash or used to purchase gift cards. We may change store credit terms with reasonable notice on our Website.

 

 

Production & Theatre Discount Policy

Verified film, TV and theatre production teams may receive a 10% discount on all current and future orders, provided they:

Shipping and Returns

Orders are shipped via Australia Post, with tracking included. Deliveries are dispatched directly from our supplier in New South Wales.

  • Delivery times are estimates only and not guaranteed.

  • Australia Post may choose to leave parcels without signature if safe to do so.

  • Authority to Leave, delivery instructions, or redirection must be managed by the customer directly with Australia Post using the tracking link.

  • We are not responsible for delays caused by Australia Post, weather, strikes, or other factors outside our control.

  • Shipping costs are calculated at checkout. Express options may not be available for all areas or products.

 

Returns Policy

  • What we accept

    • Returns are accepted only for items that are faulty, damaged on arrival, or not as described.

  • Timeframe

    • Contact us within 7 days of delivery to lodge a faulty/DOA claim.

  • Condition for returns

    • Items must be returned with original packaging and any accessories.

    • Unless damaged prior to receipt, items must be unused and in saleable condition.

  • What we don’t accept

    • No change-of-mind returns (opened or unopened).

    • No refunds/exchanges for personal taste (e.g., flavour/draw).

  • How to lodge a claim

    • Email your order number, brief description, and clear photos of the item and packaging within 7 days.

    • We’ll assess and provide return instructions (RMA) if approved.

  • Outcome

    • For approved claims, we’ll provide a refund, replacement, or store credit (at our discretion) once the item is received and inspected.

    • Refunds go to the original payment method.

  • Return postage

    • Customer is responsible for returning items unless we agree otherwise in writing.

    • For approved faulty/incorrect claims, we may reimburse reasonable return costs after inspection.​

  1. Privacy Statement

    1. This Privacy Policy sets out how the NicoFree Group collects, shares and handles your Personal Information.

    2. We respect your privacy and are committed to protecting your personal information. Our privacy policy outlines our approach to privacy and how we collect, use and protect your personal information. It also sets out your rights in relation to accessing the personal information we collect and hold about you. We are bound by Australian privacy legislation which includes the Australian Privacy Principles (or APPs) in the Privacy Act 1988 (Cth).

    3. Personal information is defined in the Privacy Act 1988 (Cth) and means information or an opinion about an identified individual, or an individual who is reasonably identifiable.

    4. Our websites may contain links to third party websites. We are not responsible for the privacy policies of any third party websites. We recommend that you review the privacy policy of each website you visit.

  2. Collection of Personal Information and other Information

    1. We collect personal information for the primary purpose of conducting our business as an online retailer, trader and service provider including to:

      1. sell, deliver, administer, improve the products and services on our platform;

      2. personalise your experience on our platform and with our services;

      3. process payments;

      4. deal with feedback or complaints about the goods and service sold or available on our platform and provide remedies where required;

      5. undertake data to enable us to better understand our customers’ requirements and preferences, conduct product and market research, personalise and improve our platform, services, websites and apps (our platform), and to provide offers that are of greater interest or benefit to customers;

      7. undertake and administer promotions, competitions, marketing activities, direct marketing, database compilation and analytics, analysis of trends and demographics and other marketing or promotional activities;

      8. manage our stores, supply arrangements and inventory and administer our platform;

      9. recruit and assess future employees; and

      10. maintain and update our records.

    2. The personal information we collect from you will include information you give us when you:

      1. register or subscribe to our platform or one of our newsletters;

      2. complete a transaction with us; and

      3. contact us.

    3. In addition, we may collect personal information you disclose to third parties who are affiliated with us or otherwise provide services to us. These third parties will collect and store your personal information in accordance with their own privacy policies and procedures, which they will make known to you. We will take reasonable steps to ensure that the individual is made aware of the matters above.

      2. your contact details including your email, home/delivery address and billing address;

      4. other information that we collect in the course of transactions or interactions on our platform or with our Related Companies.

    5. We only collect sensitive information in circumstances where you consent to the collection of this information, or it is reasonably necessary for, or directly related to the purpose outlined above.

    6. We may collect personal information from individuals who are not customers of our business but whose personal information is given to us by those individuals via our website or in the course of a transaction.

    7. Where reasonably practicable, we attempt to collect personal information directly from the individuals themselves, or from our Related Companies.

    8. When we collect information, we will generally explain to the individual why we are collecting it, who we give it to and how we will use or disclose it or, alternatively, those matters will be obvious from the circumstances.

    9. We will collect personal information from you by lawful and fair means and not in an unreasonably intrusive way.

    10. When you visit our platform, we, and/or third parties, may place cookies, tags and pixels on your browser to enhance and manage our platform and improve our business and the services we provide to you.

    11. We and/or Google may use this information to optimise and place advertisements, including advertisements of third party vendors and remarketing advertisements based on past visits to this platform, on our own and third party websites. Google's ability to use and share information collected by Google Analytics is restricted by the Google Analytics Terms of Use and Privacy Policy.

    12. We and our Related Companies may combine this information with similar information from Related Company websites to undertake data analytics and matching, to personalise websites and (where you have consented to receiving offers or direct marketing) to offer products or provide services to you or send direct marketing to you.

    13. In addition to personal information, we may collect other information about you or the device you use to access our platforms. By using our platform and agreeing to this policy, you grant us permission to place and store pixels, tags and cookies on your browser which may be used by us to collect information about how you use our platforms and websites you visit, including the following information:

      1. your device's operating system;

      2. your browser type and capabilities;

      3. your device's Internet Protocol (IP) address and geolocation;

      4. your browsing behaviour on our platforms including but not limited to:

        1. products you have viewed, added to cart and/or purchased;

        2. your searches and search history;

        3. pages you have visited, including how you were referred to each page; and

      5. page usage statistics, including the time spent on each page;

    14. In addition, third parties may place and read cookies on your browser or use web beacons or similar technologies to collect information, including, where applicable, for the Google Trusted Stores program or other third party affiliate marketing or aggregation services.

    15. Cookies can be managed by accessing the individual settings in your browser.

  3. Using and Disclosing Your Personal Information

    1. We will generally use or disclose your personal information for the primary purpose for which it was collected, or for a related secondary purpose where you would reasonably expect us to use or disclose the personal information for that secondary purpose. We may otherwise use and disclose your personal information if you have given us consent in accordance with this Privacy Policy for the use or disclosure or it is required or authorised by law.

    2. Generally, we use and disclose your personal information for the purpose of providing you with the goods or services that you have requested, or otherwise to enable us to carry out our business as an online retailer of goods and services, trader and service provider.

    3. We may generally disclose your information to third parties in order for them to provide or market services to you, such as our commercial partners for NicoFree. We will not sell your personal information to third parties, and (unless connected with clauses 3.9 and 3.10 below) any third party we disclose information to will be for a purpose connected with your experience or the products or services provided on our platform or our business as an online retailer of goods and services, trader and service.

    4. If those purposes for which we have collected the information involve providing personal information about an individual to any third party, we will take appropriate and reasonable steps to ensure any personal information is protected.

    5. We will generally only use personal information for marketing if you have given express or implied consent or it is impracticable to seek consent before this use.

    6. When registering with us, you consent to us using your personal information (such as your email address or phone number, your purchase history with us, your browsing history on our platform, and information collected about you from Related Companies) for direct marketing purposes. This includes sending you deal emails or SMS notifications about our products and services, and personalising the appearance of the platform for you based on the personal information we collect about you. You may opt out of receiving these direct marketing communications at any time and you can manage your subscription preferences in your account.

    7. When opting into 'Notify Me' emails, you consent to us sending you a notification email once a product on your Wishlist is back in stock. You may opt out of receiving these notification emails at any time and you can manage your notification preferences in the Wishlist section of your account.

    8. We may disclose your information to (a) other members of the NicoFree Group; and (b) our Related Companies, each of whom may use that information to undertake data analytics and matching to enable them to better understand your requirements and preferences, and (if you interact with that business) to personalise and improve their offer to you and to offer products or providing services to you or send direct marketing to you (where you have consented to receiving direct marketing).

    9. In addition, NicoFree and our Related Companies disclose personal information to, and collect personal information from, each other to understand how you interact with them and what products and services you like, which allows NicoFree and Related Companies to better understand your preferences and requirements, conduct product and market research, personalise and improve services, websites and apps and to provide offers that are of greater interest or benefit to you.

    10. We may also provide your information to third parties that provide services to us, including third parties that provide our payment gateway, marketing, loyalty and reward program, logistics, customer service and technology support services. This may include providing your information to third parties that are located outside of Australia. Where your personal information is transferred outside Australia (including the USA, UK, Hong Kong, the Philippines, Israel, Austria and other member states of the EU). Where we do so, we ensure that these parties treat your information with strict confidentiality and have appropriate data protection arrangements.

    11. You agree and acknowledge that in the event we merge, sell or otherwise change control of our company, our business or the website to a third-party, you consent, without giving of prior notice, to our disclosure of your personal information and other data that we have collected from you to a third party or parties as part of such a transaction.

  4. Security of Your Personal Information

    1. We take steps to protect the personal information we hold against loss, unauthorised access, use, modification or disclosure and against other misuse. When no longer required, personal information is destroyed in a secure manner or deleted.

  5. Access to Your Personal Information and Complaints Procedure

    1. Under the Privacy Act 1988 (Cth), you have certain rights to access the personal information we collect and hold about you.

    2. Information we hold about you can be accessed by logging into your account on the platform and checking the information in the My Account page. You should ensure the information, such as delivery address and email, is up to date and accurate. You can find more information about the information held in your account here.

    3. You may make a request to receive any additional information we may hold about you, and we will provide this information to you within a reasonable time. When requesting such access please identify the precise type/s of information requested. You may make a request by contacting us via ‘Contact’.

    4. We take steps reasonable in the circumstances to ensure that the personal information that we collect, use and disclose is accurate, up to date and complete. Where an individual requests to correct information, we will take reasonable steps to correct the information, having regard to the purpose for which it is held. You may lodge a request to correct personal information in the manner outlined in clause 5.3 above.

    5. To make a complaint about a breach of the Australian Privacy Principles, which includes how we handle your personal information, you may contact us via ‘Contact’. We will endeavour to respond to your complaint within a reasonable time after it is received. If you are not satisfied by our response, you may acquire further information regarding privacy from the Office of the Australian Information Commissioner.
